  《北京市政府信息公开规定》已经2014年5月21日市人民政府第42次常务会议审议通过,现予公布,自2015年1月1日起施行。

  第一章 总 则

  第一条 依据《中华人民共和国政府信息公开条例》和其他有关法律、法规规定,结合本市实际,制定本规定。

  第二条 本规定所称政府信息,是指行政机关在履行职责过程中制作或者获取的,以一定形式记录、保存的信息。

  第三条 各级人民政府应当加强对政府信息公开工作的组织领导。

  市政府办公厅是本市政府信息公开工作的主管部门,负责推进、指导、协调、监督本市的政府信息公开工作。

  区、县人民政府办公室是本区、县政府信息公开工作的主管部门,负责推进、指导、协调、监督本行政区域的政府信息公开工作。

  实行垂直领导的部门在上级主管部门的领导和所在地人民政府统一指导、协调下开展政府信息公开工作。

  实行双重领导的部门在所在地人民政府的领导下开展政府信息公开工作,并接受上级主管部门的指导。

  第四条 各级人民政府以及市和区、县人民政府部门指定的政府信息公开工作机构,应当依法组织开展本行政机关政府信息公开、维护和更新公开的政府信息、对拟公开的政府信息进行保密审查以及编制政府信息公开指南、目录和工作年度报告等政府信息公开的日常工作。

  第五条 行政机关公开政府信息,应当遵循公正、公平、便民、及时、准确的原则。

  第六条 市或者区、县人民政府的职责由具体工作部门承办的,可以由该工作部门负责相关政府信息公开工作。负责相关政府信息公开工作的具体工作部门由市人民政府向社会公布。

  第七条 行政机关在政府机构改革中被撤销、合并或者调整职权的,其制作、获取的政府信息,有继续履行相关职权的行政机关的,由该行政机关负责公开;没有继续履行相关职权的行政机关的,由保存该政府信息的单位负责公开。

  多个行政机关共同制作的政府信息,由各参与制作的行政机关负责公开。

  第八条 行政机关在公开政府信息前,应当依照《中华人民共和国保守国家秘密法》以及其他法律、法规和国家有关规定对拟公开的政府信息进行审查。

  符合下列情形之一的政府信息,不予公开:

  (一)根据《中华人民共和国保守国家秘密法》等法律、法规和国家有关规定,涉及国家秘密的;

  (二)根据《中华人民共和国反不正当竞争法》等法律、法规和国家有关规定,涉及不为公众所知悉、能给权利人带来经济利益、具有实用性并经权利人采取保密措施的技术信息和经营信息的;

  (三)根据相关法律、法规和国家有关规定,涉及他人身份、通讯、健康、婚姻、家庭、财产状况等个人隐私信息的;

  (四)根据法律、法规和国家有关规定,其他不予公开的。

  行政机关公开涉及商业秘密、个人隐私的政府信息应当依照本规定第二十七条的规定执行。

  第九条 行政机关应当建立健全政府信息公开保密审查机制,明确国家秘密、商业秘密和个人隐私的审查程序和责任。

  行政机关对政府信息不能确定是否涉及国家秘密时,应当依照法律、法规和国家有关规定报有关主管部门或者同级保密工作部门确定。

  第十条 行政机关在制作政府信息时,应当确定该政府信息是否公开。对不公开的政府信息,应当注明理由。

  行政机关应当建立不公开的政府信息的动态管理机制,对符合公开要求的政府信息依法公开。

  第十一条 行政机关应当建立健全信息监测和澄清机制。行政机关发现影响或者可能影响社会稳定、扰乱社会管理秩序的虚假或者不完整信息,应当在其职责范围内发布准确的政府信息予以澄清。

  第十二条 行政机关应当建立健全政府信息发布协调机制。行政机关发布政府信息涉及其他行政机关的,应当与有关行政机关进行沟通、确认,保证行政机关发布的政府信息准确一致。

  行政机关发布政府信息依照国家和市人民政府有关规定需要批准的,未经批准不得发布。

  第十三条 行政机关公开政府信息,不得危及国家安全、公共安全、经济安全和社会稳定。

  第二章 主动公开

  第十四条 除依照《中华人民共和国信息公开条例》和国家有关规定主动公开政府信息外,根据本市实际情况,行政机关还应当重点公开以下政府信息:

  (一)财政预算决算、“三公经费”和行政经费信息;

  (二)保障性安居工程建设计划、项目开工和竣工情况,保障性住房的分配和退出等信息;

  (三)食品安全标准,食品生产经营许可、专项检查整治等信息;

  (四)环境核查审批、环境状况公报和重特大突发环境事件等信息;

  (五)招投标违法违规行为及处理情况、国有资金占控股或者主导地位依法应当招标的项目等信息;

  (六)生产安全事故的政府举措、处置进展、风险预警、防范措施等信息;

  (七)农用地转为建设用地批准、征收集体土地批准、征地公告、征地补偿安置公示、集体土地征收结案等信息;

  (八)政府指导价、政府定价和收费标准调整的项目、价格、依据、执行时间和范围等信息;

  (九)本市企业信用信息系统中的警示信息和良好信息;

  (十)政府部门预算执行审计结果信息;

  (十一)行政机关对与人民群众利益密切相关的公共企事业单位进行监督管理的信息;

  (十二)市人民政府决定主动公开的其他信息。

  第十五条 行政机关应当加强政府信息资源的规范化、电子化管理,分类整合政府信息资源,营造公众利用信息资源的良好环境,提升政府信息资源的开发利用水平。

  第十六条 属于主动公开范围的政府信息,应当自该政府信息形成或者变更之日起15个工作日内予以公开。

  对自然灾害、事故灾难、公共卫生和社会安全等重大突发事件,主管部门应当及时公开初步核实情况,并根据事态发展和处置情况,持续公开工作进展和政府应对措施等政府信息。

  第十七条 行政机关应当编制、公布政府信息公开指南和政府信息公开目录,并及时更新。

  政府信息公开指南,应当包括政府信息的分类、编排体系、获取方式,政府信息公开工作机构的名称和联系方式,政府信息公开申请的办理程序,权利救济途径等内容。

  政府信息公开目录,应当包括政府信息的索引、名称、内容概述、生成日期等内容。

  第十八条 行政机关可以通过下列渠道公开政府信息:

  (一)政府网站;

  (二)政府公报;

  (三)新闻发布会;

  (四)报纸、广播、电视;

  (五)国家档案馆、公共图书馆、政务服务大厅;

  (六)公共查阅室、资料索取点、信息公告栏、电子信息屏;

  (七)政务微博等网络平台;

  (八)其他方式和渠道。

  行政机关应当采取便于公众知晓的方式公开信息。

  第十九条 行政机关应当通过政府门户网站及时公开、更新政府信息,并提供信息检索、查阅、下载等服务。

  第二十条 市和区、县人民政府应当在国家档案馆、公共图书馆设置政府信息查阅场所,并配备相应的设施、设备,为公民、法人或者其他组织获取政府信息提供便利。其他行政机关可以根据需要设置政府信息查阅场所、设施。

  行政机关应当向同级行政服务中心、国家档案馆、公共图书馆提供主动公开政府信息的电子文本,移送主动公开的行政规范性文件纸质文本。

  第二十一条 行政机关应当设置政府信息公开咨询电话,为公民、法人或者其他组织提供咨询服务。

  市非紧急救助服务中心和各分中心可以为公民、法人或者其他组织提供政府信息公开咨询等服务。

  第三章 依申请公开

  第二十二条 行政机关应当公布受理政府信息公开申请的办公地址、办公时间、联系电话、传真号码、电子邮箱、举报电话等,方便公民申请。

  申请公开政府信息的公民存在阅读困难或者视听障碍的,行政机关应当为其提供必要的帮助。

  第二十三条 申请人向行政机关申请获取政府信息,应当采用书面形式(包括数据电文形式);采用书面形式确有困难的,申请人可以口头提出,由受理该申请的行政机关代为填写政府信息公开申请,并由申请人签字、捺印或者盖章确认。

  行政机关应当向申请人提供政府信息公开申请书格式文本;申请人也可以采用其他书面形式向行政机关提出申请。

  第二十四条 政府信息公开申请应当包括下列内容:

  (一)申请人以及代理人、代表人的姓名或者名称、证件名称和号码、电话和通讯地址等有效联系方式;

  (二)申请公开政府信息的内容描述,包括能够指向特定政府信息的文件名称、文号或者其他详尽、准确的特征描述;

  (三)获取信息的方式以及提供信息的形式要求;

  (四)受理机关名称。

  申请人委托代理人提出政府信息公开申请的,应当提供委托代理证明材料。

  5人以上(含5人)共同申请同一政府信息,可以推选1至5名代表提交申请,并提供推举证明材料。

  受理机关收到申请人公开政府信息的申请后,应当出具登记回执。

  第二十五条 行政机关收到政府信息公开申请,能够当场答复的,应当当场予以答复。行政机关不能当场答复的,应当自收到申请之日起15个工作日内予以答复;如需延长答复期限的,应当经本行政机关政府信息公开工作机构负责人同意,并书面告知申请人,延长答复的期限最长不得超过15个工作日。

  因不可抗力或者其他法定事由行政机关不能在规定期限内答复申请人或者向申请人提供政府信息的,期限中止。中止时间不计算在前款规定期限内,障碍消除后期限恢复计算。期限的中止和恢复,行政机关应当向申请人书面说明情况。

  第二十六条 申请人要求撤回政府信息公开申请的,行政机关应当准许,并登记备案。

  申请人向同一行政机关同时申请两项以上政府信息的,行政机关根据便民原则可以分别答复或者合并答复。

  第二十七条 行政机关认为申请公开的政府信息涉及商业秘密或者个人隐私,公开后可能损害第三方合法权益的,应当书面征求第三方的意见;第三方不同意公开的,行政机关不得公开。但是,行政机关认为不公开可能对公共利益造成重大影响的,应当予以公开。第三方不同意公开,行政机关决定公开的,应当在书面告知第三方后公开。

  行政机关征求第三方意见所需时间不计算在本规定第二十五条第一款规定的期限内。

  第二十八条 对申请公开的政府信息,行政机关根据下列情况分别作出书面答复:

  (一)申请公开的政府信息已主动公开的,应当告知申请人获取政府信息的方式和途径;

  (二)申请公开的政府信息属于可以公开的,应当向申请人公开;行政机关或者第三方对政府信息的使用范围有特殊要求的,行政机关应当与申请人约定,申请人签字确认后,按照约定使用公开的政府信息;

  (三)申请公开的政府信息中含有不应当公开的内容,但是能够作区分处理的,应当向申请人提供可以公开的信息内容;对不予公开的部分,应当说明理由;

  (四)申请公开的政府信息属于不予公开范围的,应当告知申请人并说明理由;

  (五)申请公开的政府信息属于行政机关在日常工作中制作或者获取的内部管理信息或者处于行政机关讨论、研究或者审查中的过程性信息,应当告知申请人不属于应当公开的政府信息;

  (六)申请公开的政府信息所涉事项属于本机关公开范围,但本机关未制作、未获取,或者未以一定形式记录、保存的,应当告知申请人申请的信息不存在并说明理由;

  (七)申请公开的政府信息所涉事项不属于本机关公开范围或者属于市人民政府公布由具体工作部门公开的,应当告知申请人,对能够确定该政府信息公开机关的,告知申请人该行政机关的名称、联系方式;

  (八)申请内容不明确的,应当告知申请人作出更改、补充;

  (九)同一申请人向同一行政机关就同一政府信息重复提出公开申请的,行政机关已经依法答复的,可以告知申请人不重复办理。

  第二十九条 行政机关对下列申请事项应当分别按照以下方式处理:

  (一)申请内容为咨询、信访、举报等事项,不属于政府信息公开申请范围的,应当告知申请人通过相应渠道提出,对能够确定负责该事项的行政机关的,告知申请人该行政机关的名称、联系方式;

  (二)申请内容属于行政程序中的当事人、利害关系人查阅案卷材料的,应当告知申请人按照相关法律、法规的规定办理;

  (三)申请公开的政府信息已经移交各级国家档案馆的,应当告知申请人按照有关档案管理的法律、行政法规和国家有关规定办理。

  第三十条 行政机关向申请人提供的政府信息应当是未经汇总、加工、分析或者重新制作的政府信息。

  行政机关依申请公开政府信息,应当按照申请人要求的形式予以提供;无法按照申请人要求的形式提供的,可以通过安排申请人查阅相关资料、提供复制件或者其他适当形式提供。

  第三十一条 行政机关应当对以下情况进行记录,并留存相关材料:

  (一)申请人没有提供有效联系方式,致使行政机关无法向申请人提供书面答复的;

  (二)征求第三方意见,无法与第三方取得联系或者未收到其回复意见的;

  (三)申请办理中的其他特殊情形。

  第三十二条 多人就同一政府信息向同一行政机关提出公开申请,行政机关同意公开,且该政府信息可以为公众知晓的,行政机关可以决定将该政府信息纳入主动公开范围。

  行政机关对申请公开的政府信息决定予以公开的,申请人可以建议行政机关将该信息纳入主动公开范围。

  第三十三条 公民、法人或者其他组织有证据证明行政机关提供的与其自身相关的政府信息记录不准确的,有权要求该行政机关予以更正。

  行政机关有权更正的,应当及时予以更正;无权更正的,应当转送有权更正的行政机关处理,并告知申请人。法律、法规、规章对信息更正有特殊程序规定的,从其规定。

  第三十四条 行政机关依申请提供政府信息,可以收取实际发生的检索、复制、邮寄等成本费用,收取的费用纳入同级财政管理;具体收费标准由本市价格和财政主管部门制定。

  农村五保供养对象、城乡居民最低生活保障对象以及领取国家抚恤补助的优抚对象,经本人申请,凭民政部门颁发的相关证件,受理机关可以免收相关费用。

  第四章 监督和保障

  第三十五条 本市各级人民政府应当建立健全政府信息公开工作考核制度、社会评议制度和责任追究制度,定期对政府信息公开工作进行考核、评议。

  第三十六条 行政机关应当在每年3月31日前,公布本行政机关的政府信息公开工作年度报告。

  政府信息公开工作年度报告应当包括下列内容:

  (一)行政机关政府信息公开组织机构、制度建设、渠道场所、教育培训等年度工作开展情况;

  (二)行政机关主动公开政府信息的情况;

  (三)行政机关依申请公开政府信息和不予公开政府信息的情况;

  (四)因政府信息公开申请行政复议、提起行政诉讼的情况;

  (五)政府信息公开的收费以及免除费用的情况;

  (六)政府信息公开工作存在的主要问题以及改进情况;

  (七)其他需要报告的事项。

  第三十七条 市政府办公厅组织开展政府信息公开年度考核工作。政府信息公开年度考核情况应当向社会公布。

  第三十八条 行政机关可以采取多种方式开展社会评议,征求公民、法人或者其他组织对本机关政府信息公开工作的意见和建议。对于合理的意见和建议,行政机关应当予以采纳。

  第三十九条 政府信息公开工作主管部门和监察机关负责对行政机关政府信息公开的实施情况进行监督检查,指导、监督本市政府信息公开责任追究工作。责任追究的方式和程序,执行本市行政问责办法。

  第四十条 公民、法人或者其他组织认为行政机关不依法履行政府信息公开义务的,可以向上级行政机关、监察机关或者政府信息公开工作主管部门举报。收到举报的机关应当予以调查处理。

  公民、法人或者其他组织认为行政机关在政府信息公开工作中的具体行政行为侵犯其合法权益的,可以依法申请行政复议或者提起行政诉讼。行政机关对在行政复议和行政诉讼中发现的政府信息公开工作相关问题应当及时纠正。

  第四十一条 行政机关违反本规定,未建立健全政府信息发布保密审查机制的,由监察机关、上一级行政机关责令改正;情节严重的,对行政机关主要负责人依法给予处分。

  行政机关违反本规定,有下列情形之一的,由监察机关、上一级行政机关责令改正;情节严重的,对行政机关直接负责的主管人员和其他直接责任人员依法给予处分;构成犯罪的,依法追究刑事责任:

  (一)不依法履行政府信息公开义务的;

  (二)不及时更新公开的政府信息内容、政府信息公开指南和政府信息公开目录的;

  (三)违反规定收取费用的;

  (四)通过其他组织、个人以有偿服务方式提供政府信息的;

  (五)公开不应当公开的政府信息的;

  (六)违反本规定的其他行为。

  第五章 附 则

  第四十二条 法律、法规授权的具有管理公共事务职能的组织公开政府信息的活动,适用本规定。

  第四十三条 教育、医疗卫生、计划生育、供水、供电、供气、供热、环保、公共交通、通讯等与人民群众利益密切相关的公共企事业单位在提供社会公共服务过程中制作、获取的信息公开,参照本规定执行。

  有关主管部门应当对所属或者管理的公共企事业单位的信息公开工作进行指导和监督。

  第四十四条 法律、法规和国家有关规定对政府信息公开另有规定的,从其规定。

  第四十五条 本规定自2015年1月1日起施行。

 
(Promulgated by Decree No. 257 of the People’s Government of Beijing Municipality on June 23, 2014)ContentsChapter I General ProvisionsChapter II Disclosure on InitiativeChapter III Disclosure upon ApplicationChapter IV Supervision and GuaranteeChapter V Supplementary ProvisionsChapter I General ProvisionsArticle 1 These Provisions are formulated in accordance with the provisions of the Regulations of the People’s Republic of China on Disclosure of Government Information as well as other relevant laws and regulations, and in light of the actual circumstances of this Municipality. Article 2 The term “government information” in these Provisions means information which is produced or obtained and, in certain forms, recorded or stored by an administrative organ in the process of performing its functions and duties. Article 3 The people’s governments at various levels shall strengthen organization and leadership with respect to disclosure of government information. The General Office of the Municipal People’s Government is the competent department for disclosure of government information within this Municipality, responsible for promotion, guidance, coordination and supervision of disclosure of government information within this Municipality.The general offices of the people’s governments at the district or county level are the competent departments for disclosure of government information within their respective districts or counties, responsible for promotion, guidance, coordination and supervision of disclosure of government information within their respective administrative areas.The departments under the vertical leadership system shall carry out disclosure of government information under the leadership of the superior competent departments and unified guidance and coordination of the people’s governments at the places where they are located.The departments under the dual leadership system shall carry out disclosure of government information under the leadership of the people’s government at the place where they are located and be subject to the guidance of the superior competent departments. Article 4 The people’s governments at various levels as well as the offices for disclosure of government information designated by the departments of the people’s governments at the municipal and the district or county level shall, in accordance with law, organize the development of daily work for disclosure of government information such as disclosure of government information of respective administrative organs, maintenance and updating of government information disclosed, examination of government information to be disclosed for confidentiality purpose, compilation of guidebooks for and catalogue of disclosure of government information and annual reports on disclosure of government information. Article 5 In disclosing government information, administrative organs shall follow the principles of impartiality, fairness, public convenience, promptness and accuracy.Article 6 Where the functions and duties of the people’s governments at the municipal and the district or county level are undertaken by specific working departments, such working departments may be responsible for disclosure of relevant government information. The specific working departments responsible for disclosure of relevant government information shall be made public to the society by the Municipal People’s Government.Article 7 Where an administrative organ is canceled, merged or adjusted of functions and duties during the institutional reform of governments and there is another administrative organ to continue performing such relevant functions and duties, the government information it produced or obtained shall be disclosed by the latter administrative organ; where there is no administrative organ to continue performing such relevant functions and duties, the government information it produced or obtained shall be disclosed by the unit maintaining the government information.Government information produced jointly by several administrative organs shall be disclosed by each administrative organ participating in the production. Article 8 Before disclosing government information, administrative organs shall, in accordance with the Law of the People’s Republic of China on Guarding State Secrets, and other laws, regulations and relevant provisions of the State, examine the government information to be disclosed.Government information shall not be disclosed in any of the following circumstances:(1) involving State secrets in accordance with the Law of the People’s Republic of China on Guarding State Secrets, and other laws, regulations and relevant provisions of the State;(2) involving technology and business operation information which is unknown to the public, can bring about economic benefits to the obligee, has practical utility and about which the obligee has adopted secret-keeping measures in accordance with relevant provisions of the Law of the People’s Republic of China on Against Unfair Competition, and other laws, regulations and relevant provisions of the State;(3) involving such personal privacy as the identity, contact information, health, marital status, family, financial conditions, etc. in accordance with relevant laws, regulations and relevant provisions of the State;(4) other government information that shall not be disclosed in accordance with laws, regulations and relevant provisions of the State.An administrative organ disclosing government information involving business secrets or personal privacy shall comply with the provisions of Article 27 of these Provisions.Article 9 Administrative organs shall establish and strengthen a mechanism of examination for confidentiality purpose in disclosure of government information and specify the examination procedures and responsibilities for State secrets, business secrets and personal privacy.When an administrative organ is not sure whether a certain piece of government information involves State secrets, it shall, in accordance with laws, regulations and relevant provisions of the State, submit the matter to the competent department concerned or to the secret-guarding department at the same level for determination.Article 10 When an administrative organ produces government information, it shall determine whether such government information shall be disclosed. As to the government information which shall not be disclosed, it shall specify the reasons therefor. An administrative organ shall establish a dynamic administration mechanism for government information that shall not be disclosed, and disclose the government information that meets the requirements on disclosure in accordance with law. Article 11 An administrative organ shall establish and improve a mechanism for information monitoring and clarification. When finding false or incomplete information which undermines or is likely to undermine social stability or disturbs administration of social order, the administrative organ shall, within the scope of its respective functions and duties, disprove such information by releasing accurate government information. Article 12 An administrative organ shall establish and strengthen a coordinating mechanism for release of government information. Where an administrative organ is to release government information which involves other administrative organs, it shall communicate with the administrative organs concerned for confirmation, so as to ensure the accuracy and consistency of the government information released by administrative organs. Where release of government information by an administrative organ requires approval in accordance with relevant provisions of the State and the Municipal People’s Government, such information shall not be released without approval. Article 13 The disclosure of government information by an administrative organ shall not endanger State security, public security, economic security or social stability.Chapter II  Disclosure on InitiativeArticle 14 Administrative organs shall, in addition to disclosing the government information disclosed on their initiative in accordance with the Regulations of the People’s Republic of China on Disclosure of Government Information and relevant provisions of the State, lay emphasis on disclosure of the following government information in light of the actual circumstances of this Municipality:(1) information about fiscal budgets and financial accounts, three public consumptions, and administrative expenses;(2) information about construction plan, start-up and completion of affordable housing projects, distribution and withdrawal of affordable houses, etc.;(3) information about food safety standards, administrative licensing for food production and operation, specialized inspection and rectification concerned, etc.;(4) information about verification on environmental inspection, bulletins of environmental conditions, major and serious environmental emergencies, etc.;(5) information about illegalities and violations in bid invitation and bidding and the settlement thereof, projects controlled or dominated by the State-owned capital subject to bid invitation;(6) information about government measures, handling progress, risk warning and precautionary measures involving work safety accidents;(7) information about approval of converting land for agriculture to land for construction, approval of expropriating collective land, announcements of land expropriation, notices of compensation and placement for land expropriation, completion of collective land expropriation;(8) information about government guided-pricing, government pricing, and the items, prices, bases, implementing time and range of the adjustment of charging standards;(9) warning information and favorable information in the enterprise credit information system of this Municipality;(10) information about the audit results of government departments’ budget implementation;(11) information about supervision and administration by administrative organs of public utility enterprises and institutions which are closely related to the interests of the people; and (12) other information determined to be disclosed by the Municipal People’s Government on initiative.Article 15 Administrative organs shall strengthen standardized and electronic administration of government information resources, integrate government information resources by classification, build a favorable environment for the public to make use of information resources, and promote the level of developing and utilizing government information resources. Article 16 Government information which is determined to be disclosed on the initiative of administrative organs shall be disclosed within 15 working days from the date on which such government information is produced or altered. As to the major emergencies involving natural disasters, calamitous accidents, public health accidents and public security incidents, the competent departments shall disclose the preliminary conditions that have been verified in a timely manner, and disclose such government information as work progress and governments’ handling measures in a continuous manner based on incident development and handling situations. Article 17 Administrative organs shall compile and release the guidebooks for disclosure of government information and the catalogues of government information disclosed, and update such guidebooks and catalogues in a timely manner.The guidebooks for disclosure of government information shall include such contents as the classification of, layout system for, and means of access to government information, and the names and means of contact of the offices for disclosure of government information, the handling procedures for applying for disclosure of government information, and relief approaches.The catalogues of government information disclosed shall include such contents as indexes, titles, summaries and dates of production of government information.Article 18 Administrative organs may disclose government information through the following channels:(1) government websites;(2) government gazettes;(3) press conferences:(4) newspaper, radio, and television;(5) national archives, public libraries, and service halls for administrative affairs;(6) public reading rooms, materials request centers, information bulletin boards, electronic information screens;(7) micro-blogs for administrative affairs and other network platforms;(8) other means and channels.Administrative organs shall adopt means which are easily accessible to the public to disclose information. Article 19 Administrative organs shall timely disclose and update government information through government portal websites, and provide services of searching, consulting and downloading information. Article 20 The people’s governments at the municipal and the district or county level shall offer places in national archives and public libraries for consulting government information, and provide appropriate facilities and equipment there, making it convenient for citizens, legal persons and other organizations to access government information. Other administrative organs may, based on the needs, offer places and facilities for consulting government information.Administrative organs shall provide administrative service halls, national archives and public libraries at the same level with electronic texts of the government information that has been disclosed on initiative, and transfer the paper texts of administrative regulatory documents that have been disclosed on initiative.Article 21 Administrative organs shall set up consulting hot lines for disclosure of government information to provide citizens, legal persons or other organizations with consulting services.Non-emergent service centers at the municipal level and its various branch centers may provide citizens, legal persons or other organizations with consulting services for disclosure of government information. Chapter III Disclosure upon ApplicationArticle 22 Administrative organs shall publish the office addresses, office hours, contact telephone numbers, fax numbers, e-mail addresses and complaint telephone numbers for accepting the application for disclosure of government information to facilitate citizens to submit applications.Where citizens applying for disclosure of government information have reading or visual and hearing difficulties, administrative organs shall provide them with necessary assistance.Article 23 Applicants applying for obtaining government information from an administrative organ shall apply in writing (including in the form of a data message); if applicants have real difficulties in applying in writing, they may apply orally and the administrative organ which accepts such application shall fill out the application form for disclosure of government information on behalf of the applicants, which shall be confirmed by the applicants through affixing signatures, fingerprints or seals.Administrative organs shall provide applicants with the standard forms of application for disclosure of government information; and applicants may also adopt other written forms to file applications with the administrative organs.Article 24 An application for disclosure of government information shall include the following contents:(1) the name or title, certificate type and number, telephone number and contact address, and other valid means of contact of the applicant and the agent or representative thereof;(2) the description of the government information the disclosure of which is applied for, including the document name or number that can refer to the specific government information or other detailed and accurate characteristic descriptions;(3) the way to obtain information and requirement on the form to provide information; and(4) the name of the organ to accept the application.Where the applicant entrusts an agent to apply for disclosure of government information, the materials to prove the entrustment shall be provided.Where more than five (including five) persons jointly apply for the same government information, one to five representatives may be elected to submit the application and the materials to prove the election shall be provided.The organ accepting the application shall issue a receipt of registration after receiving the application of the applicant for disclosure of government information. Article 25 Upon receiving an application for disclosure of government information, the administrative organ shall make a reply on the spot where it can. If the administrative organ can not make a reply on the spot, it shall make a reply within 15 working days from the date of receipt of the application; if the time limit for a reply needs to be extended, the administrative organ shall obtain consent of the responsible person of the office for disclosure of government information of this administrative organ, and inform the applicant of the matter in writing, and such extension shall not exceed 15 working days at the most.Where the administrative organ can not make a reply to the applicant or provide the applicant with government information within the specified time limit for force majeure or other legal causes, the time limit shall suspend. The time limit suspended shall not be included in the time limit specified in the preceding paragraph, which will resume after the obstacles are eliminated. The administrative organ shall explain the suspension and resumption to the applicant in writing. Article 26 Where an applicant requests to withdraw an application for disclosure of government information, the administrative organ shall permit and register the matter for the record.Where an applicant applies for more than two pieces of government information with the same administrative organ, the administrative organ may make replies respectively or jointly in accordance with the principle of public convenience.Article 27 Where an administrative organ deems that the government information the disclosure of which is applied for involves business secrets or personal privacy and that disclosure of such information may harm the lawful rights and interest of a third party, it shall consult the third party in writing; such government information shall not be disclosed if the third party does not consent to the disclosure. However, if the administrative organ deems that public interests mat be substantially affected unless such information is disclosed, it shall disclose such government information. Where the third party does not consent to the disclosure, however, the administrative organ decides to disclose such information, it shall disclose such information after informing the third party in writing.The time needed by the administrative organ for consulting the third party shall not be included in the time limit specified in Paragraph 1, Article 25 of these Provisions.Article 28 With respect to an application for disclosure of government information, an administrative organ shall make a reply respectively in writing in accordance with the following cases:(1) to inform the applicant of the methods and means of obtaining such government information, where the government information the disclosure of which is applied for has been disclosed on initiative;(2) to disclose such government information to the applicant, where the government information the disclosure of which is applied for may be disclosed; where the administrative organ or third party has specific requirements on the range of use of government information, the administrative organ shall reach an agreement with the applicant, who shall make use of the government information disclosed as agreed upon after confirmation upon signature;(3) to provide the applicant with the contents of the information that may be disclosed, where a piece of government information the disclosure of which is applied for includes any contents that shall not be disclosed but can be taken out; and explain the reasons with respect to the contents that may not be disclosed;(4) to inform the applicant of the fact and give the reasons, where the government information falls within the scope of information that may not de disclosed;(5) to inform the applicant that the government information applied for does not fall within the scope of information that shall be disclosed, where the government information the disclosure of which is applied for belongs to the internal administration information produced or obtained by the administrative organ in their daily work, or the process information under discussion, research or review of the administrative organ; (6) to inform the applicant that the government information applied for does not exist and give the reasons, where the government information the disclosure of which is applied for involves the matters that belong to the scope of disclosure of this administrative organ, however, such information is not produced or obtained, or recorded or stored in a certain form by this administrative organ;(7) to inform the applicant of the fact, where the government information the disclosure of which is applied for involves the matters that don not belong to the scope of disclosure of this administrative organ, or that shall be disclosed by other specific working departments publicized by the Municipal People’s Government; and to inform the applicant of the title of the administrative organs and the means of contact with them where the said administrative organ can identify the administrative organs which shall disclose such government information; (8) to inform the applicant to make amendments or supplements, where the contents of application are not clear; or(9) to inform the applicant that repeated applications shall not be handled, where the same applicant repeatedly applies for disclosure of the same government information with the same administrative organ.Article 29 An administrative organ shall deal with the following application matters respectively in accordance with the following ways:(1) to inform the applicant to submit such application through corresponding channel, where the contents of application relate to such matters as consultation, letters and visits, and reporting, which do not belong to the scope of application for disclosure of government information; and to inform the applicant of the title of the administrative organs and the means of contact with them where the said administrative organ can identify the administrative organs in charge of such matters; (2) to inform the applicant to deal with them in accordance with the provisions of relevant laws and regulations, where the contents of application involve looking up the materials of cases by the parties concerned or interested parties in administrative procedures; or(3) to inform the applicant to deal with the matter in accordance with relevant provisions of laws, regulations and the State related to the administration of archives, where the government information the disclosure of which is applied for has been transferred to the national archives at various levels.Article 30 The government information provided by administrative organs to applicants shall be the government information that has not been gathered, processed, analyzed or re-produced.When disclosing government information on the basis of an application, an administrative organ shall provide government information upon application in the form as requested by the applicant; if the administrative organ can not take the requested form, it may arrange for the applicant to consult relevant materials, provide duplicates or provide information in other appropriate forms.Article 31 An administrative organ shall record the following circumstances and maintain relevant materials:(1) the administrative organ has no way to provide the applicant with written replies due to the failure of the applicant to provide any valid means of contact; (2) failure to contact the third party or receive any reply from the third party, where the third party is consulted; or(3) other special circumstances during the handling of any application.Article 32 Where several persons apply for disclosure of the same government information with the same administrative organ and the administrative organ agrees to disclose such government information which may be made known to the public, the administrative organ may decide to include such government information in the scope of disclosure on initiative.Where the administrative organ decides to disclose the government information the disclosure of which is applied for, the applicant may advise the administrative organ to include such information in the scope of disclosure on initiative.Article 33 Where citizens, legal persons or other organizations have evidence to prove that the records of government information related to them which are provided by the administrative organ are not accurate, they shall have the right to request the administrative organ to make corrections. Where the administrative organ has the power to make such corrections, it shall make corrections timely; where it has no power to make such corrections, it shall refer the case to the administrative organ that has the power to make such corrections and inform the applicant of the matter. Where there are other provisions on special procedures for the correction of information in laws, regulations or rules, such provisions shall prevail.Article 34 When providing government information on the basis of an application, an administrative organ may collect the expenses actually incurred by searching, copying, mailing, etc., which shall be subject to the financial administration at the same level; the specific charging standards shall be formulated by the competent department for price and finance at the municipal level.Rural beneficiaries of five-guarantees, rural and urban citizens receiving the minimum subsistence allowances, as well as those receiving national pension and preferential treatment may, upon personal application and with relevant certificates issued by the departments for civil affairs, be exempted from relevant expenses by the accepting organs.Chapter IV Supervision and GuaranteeArticle 35 The people’s governments at various levels within this Municipality shall establish and strengthen the assessment mechanism, the public evaluation mechanism and the accountability mechanism in respect of disclosure of government information, and assess and evaluate the work done for disclosure of government information at regular intervals.Article 36 Administrative organs shall publish their annual reports on disclosure of government information before March 31 of each year.An annual report on disclosure of government information shall include the following contents:(1) the progress of annual work for disclosure of government information of the administrative organ, such as the organization structure, institutional improvement, channels and places, as well as education and training;(2) the details of disclosure of government information on the initiative of the administrative organ;(3) the details of disclosure and non-disclosure of government information by the administrative organ on the basis of application;(4) the details of applying for administrative reconsideration or filing administrative lawsuits in relation to disclosure of government information;(5) the details of expenses collected or exempted for disclosure of government information;(6) main problems which exist in disclosure of government information and the improvements made; and(7) other matters that need to be reported.Article 37 The General Office of the Municipal People’s Government shall carry out the annual assessment of disclosure of government information. The details of such annual assessment shall be publicized to the society.Article 38 Administrative organs may adopt several ways to carry out social evaluation, and solicit the opinions and suggestions from citizens, legal persons or other organizations on disclosure of government information. Administrative organs shall adopt the reasonable opinions and suggestions. Article 39 The competent departments for disclosure of government information and the supervisory organs shall be responsible for supervision and inspection of the implementation of disclosure of government information, as well as guidance and supervision of the investigation for responsibilities for disclosure of government information. The ways and procedures to investigate for responsibilities shall be subject to the measures of this Municipality for administrative accountability.Article 40 Where citizens, legal persons or other organizations deem that an administrative organ fails to perform its duties to disclose government information in accordance with law, they may report the matter to the administrative organ at a higher level, the supervisory organ or the competent department for disclosure of government information. The organ receiving such report shall investigate into and handle the matter.Where citizens, legal persons or other organizations deem that the specific administrative acts performed by administrative organs in disclosure of government information infringe upon their legal rights and interests, they may apply for administrative reconsideration or file administrative lawsuits in accordance with law. The administrative organs shall timely correct relevant faults in disclosure of government information found during administrative reconsideration or administrative lawsuits.Article 41 Where an administrative organ, in violation of these Provisions, fails to establish and strengthen a mechanism of examination for confidentiality purpose in release of government information, the supervisory organ or the administrative organ at the next higher level shall order it to make corrections; where the circumstances are serious, its principal responsible person shall be given a sanction in accordance with law.Where an administrative organ, in violation of these Provisions, falls into any of the following circumstances, the supervisory organ or the administrative organ at the next higher level shall order it to make corrections; where the circumstances are serious, the persons in charge with competent accountability and other persons with competent accountability in the administrative organ shall be a given sanction in accordance with law; where a crime is constituted, criminal liability shall be investigated for in accordance with law:(1) failing to perform the duties to disclose government information in accordance with law;(2) failing to update in a timely manner the contents of government information disclosed, guidebooks for disclosure of government information, or catalogues of government information disclosed;(3) collecting expenses in violation of provisions;(4) providing government information by way of paid-for services through other organizations or individuals;(5) disclosing government information which shall not be disclosed; or(6) committing other acts in violation of these Provisions.Chapter V Supplementary ProvisionsArticle 42 These Provisions shall apply to disclosure of government information by organizations that are authorized by laws and regulations to perform the function of administering public affairs.Article 43 Information that is produced or obtained by public utility enterprises and institutions, which are closely related to the interests of the people, in the process of providing such social and public services as education, medical and health care, family planning, water supply, electricity supply, gas supply, heat supply, environmental protection, public transportation and communications, shall be disclosed with reference to these Provisions.Relevant competent departments shall carry out guidance and supervision of the disclosure of information by public utility enterprises and institutions subordinate to or managed by them.Article 44 Where there are other provisions on disclosure of government information in laws, regulations or relevant provisions of the State, such provisions shall prevail.Article 45 These Provisions shall be effective as of January 1, 2015.
