(Promulgated by Decree No. 270 of the People’s Government of Beijing Municipality on May 17, 2016)Article 1 These Measures are formulated in accordance with the Interim Regulations on Residence Permits, by taking into account the particular situations of this Municipality, and for the purpose of enhancing the availability of urban basic public services and convenience to all permanent residents.Article 2 These Measures are applicable to handling a Beijing Residence Permit and enjoying the prescribed basic public services and convenience within the administrative area of this Municipality on the part of Non-native Residents in Beijing.Article 3 A Beijing Residence Permit is a certificate for non-native residents in Beijing to live in Beijing, enjoy basic public services and convenience as permanent residents, as well as apply for permanent residence registration based on points.Non-native residents in Beijing who are required to prove the fact of residence to enjoy basic public services and convenience shall produce the Beijing Residence Permit thereof; the government and relevant departments which provide non-native residents in Beijing with basic public services and convenience shall verify the Beijing Residence Permit thereof.Article 4 The municipal and district people’s governments shall strengthen the leadership, organization and coordination of the service and management of non-native residents in Beijing within their respective administrative area, establish and improve the mechanism for providing basic public services and convenience to the holder of a Beijing Residence Permit, include the work of providing basic public services and convenience to the holder of a Beijing Residence Permit in national economic and social development planning and plans, as well as ensure the holder of a Beijing Residence Permit enjoy relevant public services and convenience.The departments for development and reform, education, public security, civil affairs, judicial administration, human resources and social security, housing and urban-rural development, land and resources, health and family planning and etc. shall, according to their respective functions and duties, do a good job in the protection of the rights and interests of, and service and managements of the holder of a Beijing Residence Permit.Article 5 Public security authorities shall be responsible for temporary residence registration and for accepting applications for, producing, issuing and endorsing a Beijing Residence Permit, as well as other certificate management work.The residents’ committees, villagers’ committees, employers, schools and house lessors shall assist relevant departments in doing a good job in the acceptance of applications for and issuance of a Beijing Residence Permit, service and management of the holder of a Beijing Residence Permit and etc..Article 6 Non-native residents in Beijing shall, according to the provisions of public security departments under the State Council, go to the public security stations at the place of residence or the community registration service institutions for non-native residents in Beijing authorized by public security authorities to report temporary residence.Public security stations or the community registration service institutions for non-native residents in Beijing authorized by public security authorities shall provide temporary registration service.Article 7 Under the following circumstances, non-native residents in Beijing may go to the public security stations at the place of residence or the community registration service institutions for non-native residents in Beijing authorized by public security authorities to apply for a Beijing Residence Permit:(1) living in Beijing for more than 6 months; and(2) having a legal and stable job in Beijing, or having a legal and stable place to live in Beijing or continuously receiving full-time education in Beijing.Having a stable job in Beijing as referred to in the subparagraph (2) of this Article shall mean that they may remain employed for more than 6 months in this Municipality in the future;Having a stable place to live in Beijing as referred to in the subparagraph (2) of this Article shall mean that they have a place which may allow them to live in this Municipality for more than 6 months in the future;Continuously receiving full-time education in Beijing as referred to in the subparagraph (2) of this Article shall mean that they retain their status as a student and receive full-time education in primary or secondary schools in this Municipality, as well as retain their status as a student or receive full-time education for a degree in secondary vocational schools, regular institutions of higher education or scientific research institutions qualified for graduate education in this Municipality.Article 8 Those who apply for a Beijing Residence Permit shall produce the identity cards or other legal and valid identity documents thereof, submit the recent bareheaded photos thereof, as well as truthfully provide relevant materials which can prove that they conform to the conditions as prescribed in Article 7 hereof.A certificate of residence period shall include the temporary residence registration information, a valid Temporary Residence Permit and other materials of non-native residents in Beijing which may prove residence period; an employment certificate shall include an industrial and commercial business license, a labor contract, a labor relationship certificate issued by employers or other materials which may prove legal and stable employment; a domicile certificate shall include, among others, a housing lease contract, documents of title to property, a housing purchase contract or an accommodation certificate issued by house lessors, employers or schools; an education certificate shall include a student’ identity card, materials that may prove continuous education issued by schools or scientific research institutions and etc.The specific requirements of evidential materials shall be formulated by the municipal public security organs, together with the departments for human resources and social security, industry and commerce, judicial administration, housing and urban-rural development, land and resources, education and etc., which shall be published to the society.Article 9 Juveniles under the age of 16, the elderly or the disabled with mobility problems and etc. may apply for a Beijing Residence Permit by the custodians or close relatives thereof on their behalf. The custodians or close relatives who makean application on their behalf shall provide the legal and valid identity documents of the principals and agents, as well as a certificate which may prove the existence of the custodian relationship and the principal-agent relationship.Article 10 Where public security stations or the community registration service institutions for non-native residents in Beijing authorized by public security authorities receive application materials for a Beijing Residence Permit, they shall deal with the applications according to the following circumstances:(1) Where the application materials are complete and conform to requirements, they shall accept such applications on the spot;(2) Where the application materials have mistakes that may be corrected on the spot, they shall permit applicants to make corrections on the spot, and shall accept such applications on the spot which conform to acceptance conditions after the correction;(3) Where the application materials are not complete or do not conform to requirements, they shall notify applicants on the spot or once and for all within 5 days of all contents that shall be added or corrected. Where they fail to notify applicants beyond the prescribed time limit, such applications shall be deemed as accepted from the date of receiving the application materials;(4) Where the application materials are not complete or do not conform to requirements, and applicants refuse to add application materials or make corrections after notification, such applications shall not be accepted.Where public security stations or the community registration service institutions for non-native residents in Beijing authorized by public security authorities decides to accept or decides not to accept applications, they shall give reasons to applicants and issue written documents.Article 11 Where public security stations or the community registration service institutions for non-native residents in Beijing authorized by public security authorities decide to accept applications, they shall timely submit the materials provided by applicants to the district public security authorities.The district public security authorities shall, together with the departments for human resources and social security, industry and commerce, judicial administration,housing and urban-rural development, land and resources, education and etc., verify the materials regarding identity, residence period, employment, domicile and education provided by applicants according to their respective functions and duties. A Beijing Residence Permit shall be issued by the district public security authorities through the public security stations or the community registration service institutions for non-native residents in Beijing authorized by public security authorities to applicants conforming to conditions within 15 days from acceptance of applications; as to applicants not conforming to conditions, the district public security authorities shall give a notice in writing and give reasons through the public security stations or the community registration service institutions for non-native residents in Beijing authorized by public security authorities.Where the time limit as prescribed in the second paragraph of this Article shall be extended for legal reasons, the period for producing and issuing a Beijing Residence Permit shall not exceed 30 days.Article 12 Where a Beijing Residence Permit is damaged so as to be difficult to identify or lost, the holder thereof shall go to the public security station at the place of residence or a community registration service institution for non-native residents in Beijing authorized by public security authorities to apply for handling replacement or reissuance procedures.Where the holder of a Beijing Residence Permit applies for replacement for a new one as the original one is damaged so as to be difficult to identify, he/she shall return the original one.Article 13 Where the holder of a Beijing Residence Permit changes its residence in Beijing, he/she shall timely go to the public security station at the place of residence or a community registration service institution for non-native residents in Beijing authorized by public security authorities to apply for handling residence information change procedures.Article 14 A Beijing Residence Permit has to be endorsed once a year.Where the holder of a Beijing Residence Permit intends to live in Beijing continuously, he/she shall, within 1 month before the expiration of each year of residence, submit to the public security station at the place of residence or a community registration service institution for non-native residents in Beijing authorized by public security authorities relevant materials which may prove thathe/she conforms to the conditions as prescribed in Article 7 hereof, and apply for handling endorsement procedures.Where the holder fails to handle endorsement procedures beyond the prescribed time limit, the applicable functions of a Beijing Residence Permit shall suspend; where he/she handles endorsement procedures later, the applicable functions of a Beijing Residence Permit shall resume; the residence years in Beijing of the holder shall be counted continuously from the day on which the holder handles endorsement procedures.Article 15 When applying for, or applying for replacement or reissuance of a Beijing Residence Permit, as well as handling such procedures for change of residence information and endorsement, applicants shall be responsible for the authenticity and legality of the materials provided thereby.Where applicants issue false evidential materials, public security authorities shall not accept their applications; where their applications have been accepted, public security authorities shall terminate the procedures and shall not issue a Beijing Residence Permit; where a Beijing Residence Permit has been issued, it shall be revoked.Article 16 The district public security authorities shall cancel a Beijing Residence Permit if the holder thereof:(1) is dead;(2) has registered a permanent residence in Beijing;(3) conforms to other circumstances as provided by laws, regulations and rules where the Beijing Residence Permit shall be cancelled. Article 17 The holder of a Beijing Residence Permit may enjoy the rights of employment, participating in social insurances and depositing, withdrawing and using housing funds in Beijing according to law.The municipal and district people’s governments and relevant departments shall, according to relevant provisions, provide the holder of a Beijing Residence Permit with basic public services and convenience provided in Article 12 and 13 ofthe Interim Regulations on Residence Permits, as well as actively create conditions to gradually expand the scope of the availability of public services and convenience, improve service standards, and regularly make public the scope of public services and convenience available to the holder of a Beijing Residence Permit.The holder of a Beijing Residence Permit shall enjoy basic public services and convenience in Beijing according to relevant provisions of the State and this Municipality.Article 18 This Municipality shall, according to the requirements of the State, as well as the comprehensive carrying capacity and economic and social development needs of this Municipality, establish a point-based residence registration system for those who have a legal and stable job and a legal and stable place to live, participate in urban social insurances for prescribed years and live continuously for prescribed years in Beijing.Article 19 Public security stations, the community registration service institutions for non-native residents in Beijing authorized by public security authorities, as well as relevant departments responsible for protecting the rights and interests of and service and management of the holder of a Beijing Residence Permits and the staff thereof shall keep confidential the personal information of non-native Residents in Beijing obtained during their work.Article 20 The municipal public security authorities shall strengthen the daily supervision and management of the handling of a Beijing Residence Permit, establish and improve relevant working systems for supervision and management, as well as do a good job in the business training, guidance and supervision of the staff responsible for issuing a Beijing Residence Permit of public security stations and the community registration service institutions for non-native residents in Beijing authorized by public security authorities.Article 21 This Municipality shall, according the principles of unified planning and resource sharing, establish and improve information systems in terms of employment, education, social security, house property, credit, health and family planning, marital status, residence permits and etc., so as to provide information support for enhancing the availability of urban basic public services and convenience to all permanent residents.The departments for public security, human resources and social security, housing and urban-rural development, land and resources, education, civil affairshealth and family planning and etc. shall gradually use modern information technologies and other convenient and fast means to provide convenience to non-native residents in Beijing for them to apply for and report relevant information.Article 22 The Beijing Residence Permit shall be produced by the municipal public security authorities on a unified manner. The first application will be free; while the cost for producing the permits shall be paid for replacement or reissuance of a Beijing Residence Permit. Endorsement will be free.Article 23 Relevant units and individuals, violating the provisions of the Interim Regulations on Residence Permits and these Measures during the application for, and use and management of a Beijing Residence Permit, shall be investigated for legal liabilities by public security authorities and other relevant administrative departments according to the provisions of the Interim Regulations on Residence Permits and other laws, regulations and rules.Article 24 These Measures shall enter into force as of October 1, 2016. The Provisions of Beijing Municipality for the Administration of Registered Permanent Residence of Non-native Residents in Beijing promulgated by Decree No. 11 of the Municipal People’s Government on June 13, 1995 and amended by Decree No. 12 of the Municipal People’s Government on December 31, 1997 shall be repealed simultaneously.
